Terms of Use

These Terms of Use ("Terms") govern your use of the MikaAi mobile application (the "App") provided by FERNLY DIGITAL SERVICES LTD ("we", "us"). By installing or using the App you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old (or the age of majority where you live, if higher) to use the App.

2. The service

The App lets you create AI-generated videos and images from a photo you upload, using effects available in the App. Your photo is processed on our servers and by our AI service providers. Results are created automatically by AI: they may be inaccurate, unexpected or differ from the preview, and similar requests may produce different results. We may add, change or remove effects and features at any time.

The App uses an anonymous account linked to your device. If you delete the App or change devices, your history may not be recoverable; purchases can be restored through Google Play where supported.

3. Acceptable use

You may upload only photos that you own or have the right to use, and only photos of people who have given their consent. You must not use the App to upload, create or share content that:

• sexualizes, exploits or endangers minors in any way (child sexual abuse material). We report such content to the relevant authorities;
• depicts real people nude, partially nude or in sexual situations, or "undresses" a person;
• impersonates a real person or creates deepfakes of a person without their consent, or is intended to deceive, defraud or mislead (including fake news, fake evidence or political disinformation);
• is sexually explicit, pornographic, or promotes violence, self-harm, terrorism, hate or harassment;
• infringes copyright, trademark, privacy, publicity or other rights of any person;
• is otherwise illegal or violates Google Play policies.

You also must not attempt to bypass moderation, reverse engineer the App or our servers, use automated means to access the service, or resell the service.

Requests are checked by automated moderation before generation and prohibited requests are blocked. We may remove content, refuse requests and suspend or terminate access for any violation, without refund of tokens used in the violating requests where permitted by law.

4. Reporting content

If you see a result that is offensive, harmful or violates these Terms, use the "Report" button next to the result in the App, or email support@spikago.com. We review reports and use them to improve our moderation. Rights holders can send infringement notices to the same address, identifying the content and the right concerned.

5. Your content

You keep all rights you have in the photos you upload ("Inputs"). You grant us and our service providers a limited, worldwide, non-exclusive, royalty-free license to store and process your Inputs solely to provide the service to you, for the period described in our Privacy Policy.

Subject to these Terms and applicable law, we assign to you any rights we may have in the results generated for you ("Outputs"), and you may use them for personal and commercial purposes. You are solely responsible for your Inputs and Outputs and how you use them, including obtaining any consents from people depicted. AI-generated content may not be protected by copyright in some countries, and other users may receive similar outputs. When you share Outputs publicly, you must not present them as real footage of real events or people, and you should indicate that they are AI-generated where the law or the platform requires it.

6. Subscriptions and tokens

• Subscriptions. The App offers weekly and yearly subscriptions purchased through Google Play. A subscription includes a set number of tokens per period: 30 tokens per week (weekly plan) or 150 tokens per year (yearly plan). Prices are shown in the App and in Google Play before purchase.
• Tokens. Each generation uses tokens; the cost of an effect is shown in the App before you start. Additional tokens can be purchased as one-time in-app purchases. Tokens have no cash value, cannot be transferred or exchanged for money, and are used only within the App. Subscription tokens are credited at the start of each billing period.
• Automatic renewal. Subscriptions renew automatically at the end of each period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your Google Play account is charged on renewal.
• Cancellation. You can cancel at any time in Google Play: Play Store → Profile → Payments & subscriptions → Subscriptions → MikaAi → Cancel. After cancellation, the subscription remains active until the end of the paid period. Deleting the App does not cancel a subscription.
• Free trials and offers. If an offer or free trial is available, its terms are shown before purchase. Unless you cancel before the trial ends, the subscription converts to a paid subscription.
• Refunds. Payments are processed by Google Play, and refunds are handled according to Google Play's refund policies. You can request a refund through Google Play. Nothing in these Terms limits any rights you have under mandatory consumer law.
• Failed generations. If a generation fails for technical reasons on our side, contact us and we will restore the tokens used for it.

7. Disclaimer of warranties

The App and all Outputs are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, non-infringement or uninterrupted availability. We do not guarantee that any particular result will be produced.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or reputation, arising from your use of the App or of Outputs. Our total liability for any claim relating to the App is limited to the amount you paid us for the App in the 12 months before the claim. Some jurisdictions do not allow these limitations, so they may not apply to you.

9. Indemnity

You agree to indemnify us against claims by third parties arising from your Inputs, your use of Outputs, or your violation of these Terms or of others' rights.

10. Termination

You can stop using the App at any time. We may suspend or end your access if you violate these Terms or if required by law. Sections 5 (licence to Outputs), 7, 8 and 9 survive termination.

11. Changes

We may update these Terms. We will post the new version on this page with a new effective date and, for significant changes, notify you in the App. Continued use after changes means you accept them.

12. Governing law

These Terms are governed by the laws of the country in which FERNLY DIGITAL SERVICES LTD is incorporated, without prejudice to mandatory consumer protection laws of your country of residence.
